Crypto exchange BitMEX is facing a new class action lawsuit from customers demanding the return of 622 Bitcoin. The complaint was filed in a New York court just as the platform began its regulator approved wind down ahead of a full closure in September. Plaintiffs BKX Services and David Namdar claim they lost large amounts of Bitcoin during liquidations between 2018 and 2020. They are asking the court to return the actual coins rather than just cash value, citing claims of fraud and replevin.

The lawsuit argues that BitMEX used an aggressive liquidation system that closed positions when unrealized losses reached fifty percent of posted collateral. According to the court filing, the exchange kept the remaining collateral instead of giving it back to traders. The complaint also alleges that an internal trading desk had unfair visibility into customer positions, and could execute trades during server freezes while regular users were locked out.

BitMEX leadership has strongly pushed back against the claims. The current CEO called the lawsuit spurious and opportunistic, stating that the company plans to fight the allegations. Meanwhile, the exchange continues its orderly shutdown process, giving users until September to withdraw funds while assuring the public that assets still exceed liabilities.
